These Terms of Service ("Terms") govern your access to and use of the MoveTara mobile application and web platform operated by MoveTara ("Company", "we", "us", "our"), headquartered at Hyderabad, Telangana 500019, India, founded by Pradhudas Avanigadda and Parise Lakshmi Venkata Subrahmanyam. By creating an account or using MoveTara, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By registering for, accessing, or using MoveTara, you confirm that you are at least 18 years of age, have the legal capacity to enter into binding agreements, and accept these Terms in full. If you are using MoveTara on behalf of a business, you represent that you have authority to bind that business to these Terms.

2. Description of Service

MoveTara is a Software-as-a-Service (SaaS) platform that provides:

• Hostel and property management tools for property owners
• Warden management and task assignment features
• Tenant onboarding, stay tracking, and communication tools
• Payment recording, expense tracking, and financial reporting
• Complaint management and support ticketing
• Announcements, notifications, and operational dashboards

3. Account Registration

• You must provide accurate, complete, and current information during registration
• You are responsible for maintaining the confidentiality of your registered phone number and MPIN
• You must notify us immediately of any unauthorized access to your account
• One person or entity may not maintain more than one active account without prior written consent
• Accounts are non-transferable

4. Subscription and Payment

MoveTara operates on a subscription model. Subscriptions are purchased exclusively on the web at movetara.com/upgrade. The mobile app itself does not sell, accept, or process subscription payments — it launches your default browser to complete the purchase on our website. By subscribing you agree to:

• Pay the applicable subscription fees for your selected plan and capacity
• Subscription fees are charged in Indian Rupees (INR) and are inclusive of GST as applicable
• Payments are processed by our payment partner Razorpay (PCI-DSS Level 1 certified). Card / UPI / netbanking credentials are entered on Razorpay's secured page and are never stored by MoveTara
• Fees are non-refundable except as required by law or as stated in our refund policy
• We reserve the right to modify pricing with 30 days' advance notice
• Failure to pay will result in suspension of your account after a grace period of 7 days
• Downgrading your plan mid-cycle is effective from the next billing period

5. Refund Policy

• Monthly plans: No refund after the billing period has started
• Annual plans: Pro-rata refund available within the first 7 days
• Technical issues: If we are unable to provide the Service for more than 72 consecutive hours, you are entitled to a pro-rata credit
• All refund requests must be submitted to support@movetara.com

6. Acceptable Use

You agree not to:

• Use MoveTara for any unlawful purpose or in violation of applicable laws
• Upload false, misleading, or fraudulent tenant or property information
• Attempt to access accounts, systems, or data that you are not authorized to access
• Reverse engineer, decompile, or attempt to extract the source code of the platform
• Use automated tools, bots, or scrapers to access the Service
• Resell, sublicense, or white-label the Service without written consent
• Upload content that is defamatory, harassing, or violates third-party rights

7. Data Ownership

• You retain full ownership of all data you enter into MoveTara (hostel records, tenant data, financial records)
• We do not claim ownership over your data
• You grant us a limited license to store and process your data solely to provide the Service
• Upon account deletion, we will delete your data within 30 days as described in our Privacy Policy
• You can export your data at any time by contacting support@movetara.com

8. Uptime and Service Availability

We target 99.5% monthly uptime for the MoveTara platform. Planned maintenance windows will be communicated 24 hours in advance. We are not liable for downtime caused by factors outside our control, including third-party service outages (Supabase, Firebase), internet connectivity issues, or force majeure events.

9. Intellectual Property

All intellectual property rights in the MoveTara platform — including software, design, trademarks, logos, and documentation — are owned by MoveTara. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as described herein.

10. Termination

Either party may terminate the Service relationship at any time. You may cancel your subscription from within the app or at movetara.com/account. We may suspend or terminate your account if:

• You breach these Terms and fail to remedy the breach within 7 days of notice
• Your subscription payment fails and remains unpaid after a 7-day grace period
• We are required to do so by law or court order
• We reasonably believe your account is being used for fraudulent activity

11. Limitation of Liability

To the fullest extent permitted by law, MoveTara shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities arising from your use of the Service. Our total cumulative liability for any claim arising out of or related to these Terms shall not exceed the amount you paid to us in the 3 months preceding the claim.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any dispute arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the competent courts in Hyderabad, Telangana, India.

14. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via in-app notification or email at least 14 days before taking effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
